Sometimes spying an application does not pick up an element because of how the application is built (potentially an invisible for or element in front of your element will be picked up). Also - have you read the Java Automation Guide on the portal. There are some performance features that can mean some elements might not be found (read the bit about decendtree and ignorenotshowing).
